1. Acceptance of Terms

• By accessing or using DeckSight ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
• These Terms apply to all users, including free-tier users, paid subscribers, and visitors of publicly shared document links.

2. Description of Service

• DeckSight is a document analytics platform that allows users to upload PDF documents, share them via unique links, and track viewer engagement (views, time spent per page, email capture).
• Features available depend on the subscription plan selected. We reserve the right to modify or discontinue features with reasonable notice.

3. Accounts & Registration

• You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised access at hello@decksight.io.
• You must be at least 16 years old to create an account.

4. Subscriptions & Billing

• DeckSight offers a free plan (limited to 3 documents) and paid plans billed monthly or annually.
• Paid subscriptions are billed in advance. All payments are processed securely by Stripe.
• Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time from your account settings.
• Refunds are issued at our discretion. If you experience billing issues, contact hello@decksight.io within 7 days of the charge.
• We reserve the right to change pricing with 30 days notice to existing subscribers.

5. Intellectual Property

• You retain full ownership of all documents and content you upload to DeckSight.
• By uploading content, you grant DeckSight a limited, non-exclusive licence to store and serve your files solely for the purpose of providing the Service.
• The DeckSight platform, including its logo, code, design, and analytics engine, is the exclusive intellectual property of DeckSight and its licensors.
• You may not copy, reverse engineer, or create derivative works from the DeckSight platform.

6. Acceptable Use

• You may not use DeckSight to upload, share, or track content that is illegal, harmful, defamatory, or violates third-party rights.
• You may not use the Service to send unsolicited communications or conduct phishing attacks.
• Automated scraping, abuse of our API, or any action that disrupts the Service is strictly prohibited.
• Violation of this section may result in immediate account termination without refund.

7. Limitation of Liability

• DeckSight is provided "as is" without warranties of any kind, express or implied.
• To the maximum extent permitted by law, DeckSight shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Data & Privacy

• Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
• You are responsible for ensuring that your use of email capture features complies with applicable privacy laws (GDPR, CCPA, etc.) in your jurisdiction.

9. Termination

• You may delete your account at any time. Upon deletion, all your documents and associated data will be permanently removed within 30 days.
• We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately.

10. Governing Law

• These Terms are governed by the laws of France. Any disputes shall be resolved in the competent courts of Paris, France.
• If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force.

11. Changes to Terms

• We may update these Terms at any time. Material changes will be communicated via email to registered users at least 14 days in advance.
• Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
